Fox Valley developers fined for environmental violations

The Wisconsin Attorney General’s office won a $73,750 judgment in Winnebago County Circuit against Pat Gambsky and four development and construction firms working for him on a single-family home subdivision in the town of Menasha for environmental violations.

Fieldcrest Developers LLP, Roger Bowers Construction Inc., Pat Gambsky Builders Inc., and K&B Developments Inc., all from Kaukauna, were found liable for solid waste, open burning, asbestos and storm water violations.

The development companies and builders were cited by the Wisconsin Department of Natural Resources for demolishing and burning six older homes on the new development site called Airport Grove at Airport Road and Presher Road in the town of Menasha.

Among the 11 charges in the lawsuit, the developers and builders were accused of burning vinyl siding that had asbestos lining underneath cheap car insurance. The burn site was 720 feet from Gegan Elementary School in Menasha and the wind was blowing the smoke toward the school, according a town of Menasha police department citation that was issued to the companies for the unattended fire.

“The court’s judgment underscores the importance of compliance with state air pollution, asbestos and open burning laws that help prevent our children from being exposed to harmful emissions,” said Attorney General J.B. Van Hollen.
